Under the direction of the Manager, Workplace Investigations, the Workplace Harassment & Discrimination Investigator addresses and investigates workplace harassment and discrimination complaints received by the Workplace Harassment and Discrimination Prevention Team under Employee & Labour Relations. This role will be the liaison to key partners and business groups on highly sensitive, complex ER, including Workplace matters leveraging a solid understanding of employment laws and substantial experience applying those laws to workplace issues, and conducting related investigations.
What will I be doing?
- Managing the full investigation process from receipt to resolution for complaints of workplace harassment or discrimination by managing intake; triage; complainant, respondent and witness interviews; investigation report writing; consultation with various stakeholders and completing recommendation reports
- Conduct fact to face, telephone, and video based interviews to discover factual details, documentation and other information pertaining to allegations of misconduct. These will range from routine to complex and include interviewing company personnel as a neutral fact finder, reviewing personnel documents, and analyzing other data.
- Engage with HRBPs and stakeholders within the business regarding investigation outcomes.
- Maintenance of the corporate policies associated with responsibilities of the position, including the Metrolinx Workplace Harassment and Discrimination Prevention Policy
- Attend arbitrations and hearings as required.
- Maintains current knowledge of best practices, societal trends, and legal/regulatory requirements to assist in the strategic development, implementation, and administration of business policies and programs
- Uses existing data to research, review and analyze various issues, trends, legislative issues, systemic issues, and policy/process concerns
- Contributes to development of policies, reporting tools, directives, procedures, and program implementation to identify improved methods / techniques related to business activities and functions
What Skills and Qualifications Do I Need?
- Completion of a degree in Labour Relations or Human Resources, Law, or related field. Advanced degree preferred or a combination of education, training and experience deemed equivalent
- Demonstrated years’ experience in relevant positions such as Workplace Investigator, Employee Relations or other investigative positions
- Workplace Harassment & Discrimination Investigation skills
- In-depth knowledge of employment and safety related legislation (i.e. Occupational Health and Safety Act, Ontario Human Rights Code, Employment Standards Act)
- Experienced in complex workplace harassment and discrimination investigations, including a unionized environment
- Oral and written communication, presentation and consultation skills to provide expertise/advice to colleagues and management
- Ability to influence with strong interpersonal and conflict resolution skills focusing on business priorities
- Active listening skills in order to understand the full extent of issues, concentration to analyze issues, and resolve issues
- Agile and demonstrated flexibility to multitask and deal with interruptions for urgent requests for information
- Proficiency in computer applications, including MS Office (e.g. Outlook, Word, Excel, PowerPoint)
- Experience working with unionized employees as well as collective agreement interpretation and application.
- Analytical and problem solving skills to analyze problems, detect root causes, and resolve issues
