Description:

Our Risk, Insurance & Records Office is looking for a Manager, Freedom of Information to act as a trusted advisor to the FIPPA Head (CEO of Metrolinx) on record disclosure obligations and FIPPA related risks, challenges, and mitigation strategies and to guide and partner with senior business leaders through FIPPA processes and best practices to ensure a comprehensive and systems approach is taken on all FOI files.
You will provide senior leadership and oversight of Metrolinx's FOI program, including managing legislative, program and administrative requirements of the Freedom of Information and Protection of Privacy Act (FIPPA). You will develop service delivery policies, guidelines, and procedures to ensure a high level of statutory compliance and the efficient and effective delivery of the FOI program.
What can I expect to do in this role?
What will I be doing?
Program Management:
Provides in person briefings and disclosure recommendations to the CEO multiple times per month.
Provides expert technical advice to senior leaders on legislative interpretation and decision making to ensure FIPPA compliance.
Provides strategic advice and guidance to senior leaders on risks and challenges associated with FIPPA disclosures/non-disclosures.

Program Planning and Evaluation:
Oversees the development, implementation and maintenance of operational FOI policies and procedures to fulfill the FOI and privacy legislated requirements.
Provides expert advice into the development of policies related to the protection of privacy, access and security and develops strategies to implement policies throughout the organization and monitors and reviews Metrolinx business practices in relation to the collection, use disclosure, retention, and disposal of personal information to ensure compliance with FOI legislation.

Issues Management and Expert Advice:
Provides expert advice, recommendations and direction to FOI staff, business units, Metrolinx staff and senior management on FOI program components and the interpretation and application of FIPPA and related legislation.
Coordinates and prepares briefing notes for MTO and the Cabinet Office. Provides briefings and answers questions on contentious FOI files to MTO and Cabinet Office in preparation for Minister briefings.

Training:
Manages the development, coordination and delivery of FOI training and communication initiatives to Metrolinx staff and management to ensure all levels of staff understand FIPPA legislative and regulatory compliance requirements and the impact of those requirements on business operations and practices to ensure Metrolinx business practices, procedures and operations are compliant with FIPPA.
Leads, facilitates, and promotes activities and initiatives to foster a culture of information privacy awareness within/across Metrolinx.

Complaints/Appeals:
Represents Metrolinx in relation to the FIPPA appeals process and privacy complaints, including mediation and negotiation, and the submission of representations.
Identifies and executes measures to resolve issues, negotiates settlements, prepares or ensuring the preparation of detailed written submissions supporting FIPPA decisions; participates in oral hearings in consultation with program areas and legal counsel and the Senior Privacy Officer to ensure Metrolinx's compliance obligations are met and that Metrolinx's interests are represented to ensure optimum outcomes.

People Leadership:
Leads the FOI unit and directly manages 5 -7 FOI staff, including setting priorities and objectives.

How do I qualify?
What Skills and Qualifications Do I Need?
Completion of a degree in Business Administration, Public Administration, Law, or a related discipline – or a combination of education, training and experience deemed equivalent.
Minimum eight (8) years' experience in program management and service delivery in the field of freedom of information and protection of privacy; progressive experience in: developing, implementing, and evaluating FOI programs and policies, ensuring a high level of statutory compliance; providing expert advice to senior leadership and managing program staff in a large private or public sector organization.
Certified Privacy Manager designation is an asset.
Comfort working with minimal supervision.
Experienced manager and leader to provide technical and strategic FOI leadership and management oversight.
Expert level understanding and application of access and privacy legislation, regulations, and case law.
Highly versed in the mandate of the IPC to be able to deliver and manage Metrolinx's FOI program.
Project management experience to lead, manage, and monitor simultaneous complex requests to tight deadlines, and monitor outcomes.
Significant attention to detail.
Interpersonal, political acuity, initiative, tact, and diplomacy skills to manage the identification and response to contentious, politically and time sensitive issues/problems pertaining to requests.
Excellent and demonstrated oral/written/presentation skills to communicate risk concerns to management and staff.
Excellent people skills and ability to communicate / interface effectively with Senior Management Team and external stakeholders (e.g., Government representatives) provide strategic advice and expertise on FIPPA interpretations and application to Metrolinx programs and business operations and develop/deliver required training.
Excellent training skills and knowledge of adult education and training techniques, methods, and practices to develop and deliver required FOI training.
